A participant can also enter the Giveaway by legibly handwriting their first and last name, mailing address, email address, and “Brilliant Earth ‘Email Customer Survey Sweepstakes’” on a 3” x 5” piece of paper and mailing the same in a legibly hand-addressed, stamped envelope with sufficient postage and a return address to: Brilliant Earth, Attn: Email Customer Survey Sweepstakes, 100 Fillmore St., Ste. 200, Denver, CO 80206. Mailed Giveaway entries must be postmarked within the Giveaway Entry Period and received by October 27, 2024. No mechanically reproduced or photocopied entries accepted. Limit one (1) entry per person, per email address. Multiple entries received from any person or email address in excess of the stated maximum will be void and will not be counted. Any attempt to obtain more than the stated number of entries by using multiple/different email or mailing addresses, accounts, identities, registrations and logins, or any other methods, will disqualify all that participant's entries and that participant will be disqualified from the Giveaway and may be disqualified from future Brilliant Earth promotions. In the event of a dispute as to the identity of an entrant, the natural person who is the authorized account holder of the email address used to enter this Giveaway will be deemed the entrant. Any use of an automated system to participate is strictly prohibited and will result in disqualification from the Giveaway and all future Brilliant Earth promotions.<br> <br> 5. WINNER SELECTION, PRIZE AND ODDS: On or about October 28, 2024, the Sponsor will conduct a random drawing from among all eligible entries timely received. The odds of winning depend upon the number of entries received. One (1) prize will be awarded in the form of a $500 Brilliant Earth gift card.<br> <br> Brilliant Earth will notify the potential winner via email within approximately seven (7) days following the drawing. The potential winner must respond within ten (10) days of being notified, otherwise the potential winner will be disqualified. If a potential winner is disqualified due to failure to timely respond to Sponsor’s notification or for any other reason, the Sponsor will conduct one (1) additional drawing from among all remaining, non-winning eligible entries to award the prize to an alternate winner. Only one (1) alternate drawing per prize will be held, after which such prize will remain un-awarded. No substitution, assignment or transfer of any prize is permitted, except by Brilliant Earth, which has the right to substitute a prize with another of comparable or greater value. No returns or exchanges of prizes permitted except at Brilliant Earth's sole discretion. All taxes in connection with a prize, and the reporting consequence thereof, are the sole responsibility of the prize winner. Prize winner may be sent a tax form 1099, or other appropriate tax document, in the event the average retail value of the prize requires Brilliant Earth to submit such form. Brilliant Earth may require a signed affidavit and/or completed W9 or other appropriate tax form before awarding any prize. Prize winner may be required to pay shipping and handling fees. Brilliant Earth, may in its sole discretion, pay for shipping and handling for any winner within our normal delivery areas. Any taxes or duties owed for shipping and handling fees will be the sole responsibility of the applicable winner. Brilliant Earth and its agencies are not responsible for any delay or failure to receive notification for any reason, including inactive email or social media account(s), technical difficulties associated therewith, or any winner's failure to adequately monitor any email or social media account. RELEASE AND LIMITATION OF LIABILITY: By entering the Giveaway or receiving any prize, each entrant agrees to release and hold harmless each of Brilliant Earth and Meta Platforms, Inc. (parent company of Facebook and Instagram), and each of such party’s subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, employees, officers, directors, successors and assigns (collectively, the “Released Representatives”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Giveaway or receipt or use or misuse of any prize. The released parties are not responsible for: (1) any incomplete, incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the promotion; (2) any lost or misdirected mail, or any technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Giveaway; (4) technical or human error which may occur in the administration of the Giveaway or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Giveaway or receipt or use of misuse of any prize. Entrant agrees to release and hold each of Brilliant Earth and Meta Platforms, Inc., and each of such party’s Released Representatives harmless from any and all consequences, liability, losses, damages (including without limitation, consequential, punitive, incidental, special or increased damages and those related to personal injury, death or damage to property) and costs and expenses, of any kind, under any legal theory, arising from or related to this Giveaway, including but limited to entrant's entry and participation in this Giveaway, the acceptance and/or use (or misuse) of any prize, printing errors, any claims based upon rights of publicity and invasion of privacy. Brilliant Earth is not responsible for any fraud or misconduct on the part of the entrants. Should an entrant engage in fraud or misconduct of any nature, including but not limited to a violation of these Official Rules, that participant is subject to immediate disqualification from the Giveaway and perhaps future Brilliant Earth promotions. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant's sole remedy is another entry in the Giveaway, if feasible; if not feasible (as determined by Sponsor in its sole discretion), entrant shall have no remedy or recourse against Brilliant Earth whatsoever. In the event that production, technical, programming or any other reasons cause more than stated number of prizes as set forth in these Official Rules to be available and/or claimed, Brilliant Earth reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.<br> <br> 7. Prizes awarded through the Giveaway are not subject to Brilliant Earth's warranty for purchased products and will have no eligibility for repair or replacement for any defects.<br> <br> 8.
