One (1) winner will be selected on or around May 25, 2025 and notified by Instagram direct message. Winners will be selected subject to these Official Rules. Entry in the Giveaway does not constitute entry into any other promotion, contest, or sweepstakes. THIS GIVEAWAY IS IN NO WAY SPONSORED, ENDORSED OR ADMINISTERED BY, OR ASSOCIATED WITH FACEBOOK, INSTAGRAM, TIKTOK, TWITTER, OR OTHER SOCIAL MEDIA PLATFORMS. 2. SPONSOR: The sponsor for the Giveaway is Brilliant Earth, LLC, located at 300 Grant Ave., 3rd Floor, San Francisco, California 94108 USA ("Sponsor" or “Brilliant Earth”). 3. ELIGIBILITY: The Giveaway is open to current legal residents of the 50 United States (excluding residents of Rhode Island) and Washington, D.C. All entrants must be 18 years of age or older or age of majority or older (in those jurisdictions where age of majority is over 18). Employees of Sponsor, including employees of Sponsor’s respective affiliates and subsidiaries, such employees’ immediate family members (parent, child, sibling and spouse of each), and any other individuals living in the same households of such employees are not eligible. HOW TO ENTER: Visit Sponsor’s Instagram post announcing the Giveaway (https://www.instagram.com/brilliantearth) and follow the instructions: follow @brilliantearth on Instagram; like and save the Giveaway post; and leave a comment on the Giveaway post tagging two friends. All entrants must have an individually held Instagram account (personal, creator, and business Instagram account types are all acceptable, as long as individually held by entrant) and must be following Brilliant Earth on Instagram to win. Limit one (1) entry per person, per Instagram account. For clarity, being tagged in another person’s entry does not count towards the entry limit, and those who have been tagged in an entry may submit their own Giveaway entries. Multiple entries received from any person or Instagram account after the first entry received from that person or Instagram account will be void and will not be counted. Any attempt to obtain more than the stated number of entries by using multiple/different email or mailing addresses, accounts, identities, registrations and logins, or any other methods, will disqualify all that participant's entries and that participant will be disqualified from the Giveaway and may be disqualified from future Brilliant Earth promotions. In the event of a dispute as to the identity of an entrant, the natural person who is the authorized account holder of the email address associated with the Instagram account used to enter this Giveaway will be deemed the entrant. Any use of an automated system to participate is strictly prohibited and will result in disqualification from the Giveaway and all future Brilliant Earth promotions. By entering into this Giveaway, you agree that Sponsor may contact you on Instagram by sending you a direct message, tagging you, or naming you on Sponsor’s Instagram page. Participation is voluntary; if you have been tagged in a Giveaway entry and do not wish to participate, please contact the Sponsor via Instagram direct message to opt out. 5. WINNER SELECTION, PRIZES AND ODDS: On or about May 27, 2025, the Sponsor will conduct a random drawing of one (1) winner from among all eligible entries timely received. The odds of winning depend upon the number of entries received. One (1) prize will be awarded, a 14K Yellow Gold Bee Diamond Pendant (ARV: US $595). Brilliant Earth will notify the potential winner via Instagram direct message within approximately seven (7) days following the drawing. The potential winner must respond within ten (10) days of being notified, otherwise the potential winner will be disqualified. If a potential winner is disqualified due to failure to timely respond to Sponsor’s notification or for any other reason, Brilliant Earth will not select an alternate winner and the prize will remain un-awarded. No substitution, assignment or transfer of any prize is permitted, except by Brilliant Earth, which has the right to substitute a prize with another of comparable or greater value. No returns or exchanges of prizes permitted except at Brilliant Earth's sole discretion. All taxes in connection with a prize, and the reporting consequence thereof, are the sole responsibility of the prize winner. Prize winner may be sent a tax form 1099, or other appropriate tax document, in the event the average retail value of the prize requires Brilliant Earth to submit such form. Brilliant Earth may require a signed affidavit and/or completed W9 or other appropriate tax form before awarding any prize. Prize winner may be required to pay shipping and handling fees. Brilliant Earth, may in its sole discretion, pay for shipping and handling for any winner within our normal delivery areas. Any taxes or duties owed for shipping and handling fees will be the sole responsibility of the applicable winner. RELEASE AND LIMITATION OF LIABILITY: By entering the Giveaway or receiving any prize, each entrant agrees to release and hold harmless each of Brilliant Earth and Meta Platforms, Inc. (parent company of Facebook and Instagram), and each of such party’s subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, employees, officers, directors, successors and assigns (collectively, the “Released Representatives”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Giveaway or receipt or use or misuse of any prize. The released parties are not responsible for: (1) any incomplete, incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the promotion; (2) any lost or misdirected mail, or any technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Giveaway; (4) technical or human error which may occur in the administration of the Giveaway or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Giveaway or receipt or use of misuse of any prize.
