Sales Tax Notification FAQ

Why did I receive a sales/use tax notification from Brilliant Earth?
Laws regarding sales tax collection and reporting have been undergoing recent changes after a recent Supreme Court decision regarding the collection of sales and use taxes. Under current law, many states require residents to file and pay sales/use tax on items purchased by individuals located in that state or on items to be used in that state. Your state’s sales and use tax laws require us to send this notification to you since your purchase may be subject to such sales or use taxes.
Am I required to pay sales or use tax to my state? What tax rate do I need to pay?
State laws vary regarding the circumstances which require a tax filing or payment of tax. Please contact your state agency responsible for sales tax (e.g. the Department of Revenue, Tax Commission or Division of Taxation) for questions regarding your tax obligations, or for questions regarding what tax rate should be used.
I have determined that I do not owe any additional taxes to my state – why did I receive this notification?
Brilliant Earth has provided this notification to you in order to comply with your state’s relevant sales and use tax laws. This notification does not necessarily mean that you owe taxes. Please contact your state agency responsible for sales tax for questions regarding your tax obligations.
Why was sales tax not collected on my order?
At the time of your purchase, Brilliant Earth did not collect sales tax on orders shipped to your state and is complying with your state’s notice requirements.
The notification I received for this order is different from a previous or subsequent order that I placed – is that correct? Will future orders that I place receive a similar notification?
Because of recent changes in sales tax laws, previous or subsequent orders may have different requirements for notification or sales and use tax collection. Your state agency responsible for sales tax can provide the most up to date requirements and dates of anticipated changes for your state.
Can I send tax payments to Brilliant Earth instead of to my state?
No. If you determine that a tax payment is due, this payment should be made according to instructions from your state agency responsible for sales tax. Please contact them for further information on your tax obligations, and for instructions how to calculate and pay any amounts that may be due.
The recipient of this notification was not intended to see the purchase price, why was this notice sent to this address?
This notice was sent to the billing address for your order pursuant to your state’s sales and use tax laws.
I have additional questions regarding sales and use tax requirements in my state. I would like to obtain additional clarification on the meaning of certain sections of the letter.
The form of the notification letter is set by your state’s sales and use tax laws. Please contact a qualified tax advisor or your state agency responsible for sales tax for questions you may have regarding sales and use tax requirements in your state, or the content of the letter.
These rules are complex - how do I find simple answers to my questions?
Unfortunately, tax regulations are complex and have been changing quickly. We are encouraging our representatives to adopt streamlined sales and use tax laws to provide better clarity to consumers, and we suggest that interested individuals do the same with their elected representatives.
